The Informed Consent in the Medico-Legal Conext

Abstract
The Korean Medical Law regulating the system of medicine is now being on the process of the amendment. One of the most delicate theme in this discussion is about the new section which demonstrates the necessity of the informed consent of the doctors. The informed consent is to understand especially in the context of the variation of paradigm in the medical law: the focus of the medical law has been moved from the professional priority of the doctors to the autonomy of the patients. But the emphasis of the patient autonomy does not always bring benefit to the patients because the medical activity is something interactive between doctors and patients. For attaining the ideal in the medical law, the informed consent has to be understood in this context. The abstract classification of the types of the informed consent and the establishment of the general criterion are possible, but in the judgement of the scope of the doctoral duty the speciality of each situation is always to be considered. The new section of the informed consent is in itself not unacceptable, but because of the abstract formation it cannot be diverted onto the punishing section.
